Unlawful Methamphetamine Trafficking -- Weight: H.R.S. § 712-1240.6(2) If you find that the prosecution proved the offense of Unlawful Methamphetamine Trafficking beyond a reasonable doubt, then you must also answer the following two questions on a special interrogatory which will be provided to you: (1) Did the prosecution prove beyond a reasonable doubt that the one or more preparations, compounds, mixtures, or substances were of an aggregate weight of one-eighth ounce or more of methamphetamine, or any of its salts, isomers, and salts of isomers? (2) Did the prosecution prove beyond a reasonable doubt that the Defendant was aware that the one or more preparations, compounds, mixtures, or substances were of an aggregate weight of one-eighth ounce or more of methamphetamine, or any of its salts, isomers, and salts of isomers? You must answer each of these questions separately. Your answer to each of these questions must be unanimous. Notes If the defendant is charged under H.R.S. § 712-1240.6(2) then this instruction must be read to the jury.
