CABLE TELEVISION SERVICE FRAUD IN THE FIRST DEGREE

CABLE TELEVISION SERVICE FRAUD IN THE FIRST DEGREE: H.R.S. § 708-8200(1)(b) [In Count (count number) of the Indictment/Complaint, the] [The] Defendant, (defendant's name), is charged with the offense of Cable Television Service Fraud in the First Degree. A person commits the offense of Cable Television Service Fraud in the First Degree if he/she knowingly distributes a cable television service device and knows that the device is intended to be used to obtain cable television service without payment of applicable charges. There are three material elements of the offense of Cable Television Service Fraud in the First Degree, each of which the prosecution must prove beyond a reasonable doubt. These three elements are: 1. That, on or about (date) in the [City and] County of (name of county), the Defendant distributed a cable television service device; and 2. That the Defendant did so knowingly; and 3. That the Defendant knew that the device was intended to be used to obtain cable television service without payment of applicable charges.
